This is the privacy policy (“Privacy Policy”) that governs how we, Gable Inc. (“Company”, “we”, “our” or “us”), use Personal Data (as defined below) that we collect, receive and store about individuals in connection with the use of the website https://www.gable.to/ (together with any of its subdomains) and any other websites through which Company makes its services available, including our mobile software application called “Gable” and available at: https://gable.onelink.me/N40j/GABLE21, via tablets and any other smart device applications, and any other website that we operate (together with their subdomains, content and services, the “Site” or “App”, collectively “Services”).

We have implemented this Privacy Policy because your privacy, and the privacy of other users, is important to us. This Privacy Policy explains our online information practices and the choices you can make about the way your Personal Data (as defined below) is collected and used in connection with the Services. This Privacy Policy applies whenever you visit our Site, install or interact with our App, or otherwise access or use any of our Services. Please note that parts of this policy may not be applicable to you, depending on the jurisdiction in which you reside and the applicable laws. 

This Privacy Policy forms part of our Terms of Use, available at https://www.gable.to/terms-of-use for Guests and at https://www.gable.to/host-terms-of-use for Hosts (“Terms”). Any capitalized but undefined term in this Privacy Policy has the meaning given to it in the Terms.

1. What Personal Data We Collect and How We Collect It 

Personal Data” means any information that identifies an individual or may, with reasonable effort, identify an individual. Please note that we may also collect information that cannot be associated with a specific individual. However, if such information is combined with Personal Data, we will treat the combined information as Personal Data as long as it remains combined.

We may collect and process the following Personal Data about you:

Account. In order to use certain services, you may be required to create an Account. To List or Book a Gable on the Platform, you must register for an account by submitting the information requested in the ‘host onboarding flow’ or ‘guest onboarding flow’ (as may apply to you), or any other applicable web form. You are required to provide us with certain mandatory information such as your full name, date of birth, a valid phone number, and email address, and verify them to keep your Account secure (as well as a password, unless you choose to login using a third-party account such as Google, LinkedIn, Facebook or Apple, in which case you will not need to set up a password). For Hosts, we also collect the address of their Gables. We may also ask that you provide identity verification means, such as details of a social media account and/or a valid driver’s license or passport.

Third Party Accounts. You may choose to create an Account by clicking on a ‘connect’ or ‘sign-in’ button for a designated third-party website or service (each, a “Third Party Account”), such as Facebook, LinkedIn, Apple, or Google. Doing so links your Account and your Third Party Account. You will be required to approve the connection and the types of information we obtain from your Third Party Account.

“Contact Us” Information. If you send us a “Contact Us” request, you may be required to provide certain information such as your name, email address and any types of Personal Data you will choose to provide in your inquiry.

Share with Friends Service. The Site may enable you to invite friends to use our Site. If you receive such an invitation message, please note that we may have received your contact details such as your email address or third-party website account user name and ID from the person who sent the invitation.  

Users who choose to send invitations through the Site confirm that they are authorized to provide the recipient's contact information to us and that they do so lawfully.

Profile. Some parts of the Services may enable you to build a public profile in connection with your Account (“Public Profile”). Your Public Profile will include your name, workstyle, personal and professional interests, and other information you choose to include, such as a description of your Gables if you are a Host.

Purchases. The Services may include the option to purchase products or services from us. If you choose to make a purchase, we will collect account and billing information, invoice-related information, and other data required to process the order. 

Log Files and Technical Data. We may make use of log files. The information we collect inside log files includes your IP addresses.

2. Why We Process your Personal Data 

We may use and share the Personal Data we collect for the following purposes:

  • Providing you with our services. 
  • Communicating with you regarding your use of our Services or in response to your inquiry, registration and all other forms of communication with us. 
  • Security and access control purposes. This may include prevention or detection of fraud or financial crimes.
  • Managing and enforcing our rights, and any contracts with our customers, including managing any circumstances where transactions are disputed; manage, investigate, and resolve complaints.
  • Compliance with laws, directives and recommendations from authorities and internal regulations. 
  • Internal research and development and improvement of our Services.

3. The Legal Basis for Processing

We process Personal Data based on the basis of one or more of the following legal grounds:

  • Your consent, where required for specific processing activities; 
  • The necessity to perform a contract with you, including processing related to the provision of our Services;
  • Compliance with our legal obligations; and

4. With Whom Do We Share Your Personal Data?

We do not sell or share your Personal Data to any third party. For the purposes of providing the Services, we may share your Personal Data for the purposes described below –

  • Our affiliate companies, in order to provide you with our Services. 
  • Trusted vendors and service providers – We may share your Personal Data, as is reasonably necessary, with our service providers, including vendors and suppliers that provide development services, technology, and support for the operation, maintenance, and analysis of our Services, as well as trusted vendors providing services such as fraud detection and prevention, data storage and analytics, and payment services, who are bound by confidentiality obligations. We will only share Personal Data to the extent necessary with such service providers. 
  • We may share information, including Personal Data, in the event of a corporate transaction (e.g., sale of a substantial part of our business, merger, consolidation or asset sale of an asset or transfer in the operation thereof) of the Company. In the event of the above, the acquiring company or transferee will assume the rights and obligations as described in this Privacy Policy. 
  • We may also disclose Personal Data, or any information you share with us if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our agreements), including investigations of potential violations thereof; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our affiliates, our users, yourself or any third-party; (vi) for the purpose of collaborating with law enforcement agencies; and (vii) in case we find it necessary in order to enforce intellectual property or other legal rights.

Since we operate globally, it may be necessary to transfer data, including Personal Data, to jurisdictions other than your country of residence, which may be subject to different data protection laws. 7. Opting-Out from Receiving Marketing Materials

You may choose not to receive future promotional, advertising, or other Site-related emails from us by closing your Account or by sending an email to [email protected]. Even if you opt-out of promotional emails, we may still send you responses to “Contact Us” requests and administrative emails (for example, in connection with a password reset request) that are necessary to facilitate your use of the Site.

8. Retention

We will retain your Personal Data as long as necessary to provide our Services, as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined to take into account the type of information that is collected and for the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time.

9. Minors 

We do not knowingly collect or solicit Personal Data from anyone under the age of consent (as determined under the applicable laws where the individual resides; “Age of Consent”). By accessing, using or interacting with our Services, you certify to us that you are not under the Age of Consent. In the event we learn that we have collected Personal Data from an individual under the Age of Consent without verification of parental consent, we will delete that information upon discovery. 11. Controlling Version

The Privacy Policy has been drafted in the English language, which is the original and controlling version of this Privacy Policy. All translations of this Privacy Policy into other languages shall be solely for the convenience and shall not control the meaning or application of this Privacy Policy. In the event of any discrepancy between the meanings of any translated versions of the Privacy Policy and the English language version, the meaning of the English language version shall prevail.
